In Hicking v Basford Home Fashions a Nottingham employment tribunal (Chair: J K Macmillan) upholds a claim for equal pay for work of equal value and, applying the European Court of Justice's decision in Levez, limits its award to two years' back pay, ruling that the two-year limit on arrears of remuneration in s. 2(5) of the Equal Pay Act is not contrary to European Community law, because the limitation on arrears is not less favourable than the limitations relating to other types of breach of contract in respect of non-payment of wages.
