In Rainey v Greater Glasgow Health Board (27.11.86) EOR11A, the House of Lords rules that the defence under s.1(3) of the Equal Pay Act 1970 requires the employer to show "objectively justified grounds" for the difference in pay. One likely implication of this landmark decision will be to limit the circumstances in which an employer will be able to rely upon market forces to justify unequal pay.
