In Ezsias v North Glamorgan NHS Trust [2011] IRLR 550 EAT, the EAT held that a dismissal because of a breakdown in working relationships was a fair dismissal "for some other substantial reason" rather than conduct, even though the employee's behaviour was the cause of the breakdown.
