Employment tribunals determining whether a dismissal is fair or unfair are bound to apply the "band" or "range of reasonable responses" test, and should not put themselves in the place of management to decide whether they would have dismissed the employee or not, holds the EAT in Beedell v West Ferry Printers Ltd 7.7.00 EAT 135/00. Further, while the first limb of the Burchell test relates to the reason for the dismissal in a disputed misconduct case, the second and third limbs go solely to the question of reasonableness.
