Could the ECJ change its stance on harmonising terms and conditions following a TUPE transfer?

One of the big employment law questions this autumn is whether or not the Government will follow through on its earlier consultation regarding the reform of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246).
