Collective redundancy consultation period reduces to 45 days

Implementation date: 6 April 2013

The minimum period for collective redundancy consultation where an employer is proposing to dismiss as redundant 100 or more employees, under s.188(1A) of the Trade Union and Labour Relations (Consolidation) Act 1992, is reduced from 90 days to 45 days. Also, fixed-term contracts that have reached their agreed termination date are excluded from the requirement to consult collectively. The Trade Union and Labour Relations (Consolidation) Act 1992 (Amendment) Order 2013, which makes the changes, can be viewed on the UK legislation website.
