Protection from detriment in health and safety cases extends to workers

Implementation date: 31 May 2021

The Employment Rights Act 1996 (Protection from Detriment in Health and Safety Cases) (Amendment) Order 2021 (SI 2021/618) extends the protection against detrimental treatment to workers who, in circumstances of danger that they reasonably believed to be serious and imminent and which they could not reasonably be expected to avert, leave or refuse to return to the workplace or take steps to protect themselves or other persons.

The Employment Rights (Northern Ireland) Order 1996 (Protection from Detriment in Health and Safety Cases) (Amendment) Order (Northern Ireland) 2021 (SR 2021/103) makes the same change in Northern Ireland.
