Rehabilitation of Offenders Act 1974 (Exceptions) (Amendment) (England and Wales) Order 2010 comes into force

Implementation date: 31 March 2010

The Order enables employers to ask questions regarding spent convictions and cautions to a person who seeks to work in a controlled activity with children or vulnerable adults within the meaning of the Safeguarding Vulnerable Groups Act 2006. This right is limited to circumstances where the person seeking work is barred from regulated activity relating to children or vulnerable adults. The Order can be viewed on the OPSI website.
