When to use this model flexible working policy
Use this model policy to communicate your organisation's approach to flexible working requests when forthcoming reforms to the right to request flexible working take effect - see below for a breakdown of the expected changes. See Flexible working requests policy for a policy that reflects the current law.
This version of the policy is a preliminary draft reflecting reforms that will be introduced by:
- The Flexible Working (Amendment) Regulations 2023;
- the Employment Relations (Flexible Working) Act 2023;
- separate secondary legislation; and
- changes to the Acas code of practice on handling flexible working requests.
Although the Act has received Royal Assent, the Government needs to introduce secondary legislation in the form of regulations for the amended rights in the Act to be fully operational. It is not yet known what these regulations will say or when they will come into force. In addition, the proposed changes to the Acas code need to go through Parliament. Therefore, further revisions to this policy may be necessary.
