Automatically unfair reasons for selection for redundancy

An employee dismissed for redundancy is regarded as automatically unfairly dismissed if:

  • the circumstances that gave rise to the redundancy applied to others in the same undertaking who held similar positions as the employee, but who have not been dismissed; and
  • the reason that the employee was dismissed was an inadmissible reason.
