Advise an employee on qualifying criteria for statutory shared parental pay
Key points
There is a two-stage test for eligibility for statutory shared parental pay: an employee must be eligible in their own right and the employee's partner must also meet certain eligibility requirements.
If the couple meet the qualifying criteria, the mother or main adopter can reduce their statutory maternity pay or statutory adoption pay period, by giving a curtailment notice to their employer, leaving up to 37 weeks' shared parental pay to share with their partner.
The qualifying criteria for statutory shared parental pay include a minimum earnings level and continuous service requirement.
