Advise an employee on the qualifying criteria for paternity leave and pay in relation to a birth child
Key points
To be eligible to take either one or two consecutive weeks' paternity leave, an employee must meet specified criteria in relation to their length of service with the employer and their relationship with and responsibility for the child.
Additional criteria apply in respect of entitlement to statutory paternity pay.
An employee is not entitled to take paternity leave in respect of a child if they have taken any shared parental leave in respect of them.
