Check that an employee's ordinary parental leave notice complies with the requirements

  • The employer should check that the employee has given the required notice to take a period of ordinary parental leave and that the timing of the requested ordinary parental leave complies with the relevant requirements.
  • The requirements in relation to the notice that employees must give to take ordinary parental leave may be the subject of a collective or workforce agreement, where the terms laid down in the agreement are incorporated into affected employees' contracts of employment. Otherwise, there is a statutory fallback position that will apply.
  • Under the fallback position, the employer can require employees to provide evidence of entitlement to ordinary parental leave, for example by requesting sight of the birth certificate of the child in relation to which the employee is requesting ordinary parental leave.
