Check that an employee's paternity leave/pay notice in relation to a birth child complies with the requirements
- To exercise the right to paternity leave, an employee is required to give their employer notice of their intention to take paternity leave.
- The notice must include specified information and be given to the employer by the end of the 15th week before the mother's expected week of childbirth. Where the employee wishes to receive statutory paternity pay, the notice must include additional specified information.
- The employer should check the notice to determine if it complies with the statutory requirements. It is entitled to require the employee to provide a signed declaration confirming their eligibility in respect of paternity leave and pay.
