Check that an employee's paternity leave/pay notice in relation to a child adopted from within the UK complies with the requirements
- To exercise the right to paternity leave in relation to a child adopted from within the UK, an employee is required to give the employer notice of their intention to take paternity leave.
- The notice must include specified information and be given to the employer no more than seven days after the date on which the adopter is notified that they have been matched with a child for adoption. Where the employee wishes to receive statutory paternity pay, the notice must include additional specified information.
- The employer should check the notice to determine if it complies with the statutory requirements. It is entitled to require the employee to provide a signed declaration confirming their eligibility in respect of paternity leave and pay.
