Inform an employee that they are not eligible to receive statutory maternity pay
Key points
An employee will not be entitled to receive statutory maternity pay if they do not have the required period of continuous service with the employer or their average weekly earnings are below the lower earnings limit for national insurance purposes.
Other specified circumstances, including where the individual is in custody at the start of the maternity pay period, will mean that they have no right to receive statutory maternity pay.
Where an employee is not entitled to statutory maternity pay, their employer must provide a written explanation on a prescribed form of the reason for this.
