Where an employee has made a statutory request for flexible working, but is not eligible to do so, the employer should write to the individual explaining the reasons for this.
For example, the individual may have insufficient service with the organisation, or may have made a previous statutory request for flexible working within the previous year.
The employer may be willing to consider the application regardless of the employee's ineligibility to make a request under the statutory procedure.
