Manage an employee who does not wish to return to work after maternity leave
Key points
If an employee decides that they do not wish to return to work, they must give the employer the necessary notice of their resignation. This will be either the statutory minimum notice or the employee's contractual notice, if this is greater.
The employer may have to pay the employee their normal full pay during the notice period, depending on the length of their contractual notice period.
