Work out if an agency worker has qualified for the same basic employment conditions as directly recruited workers

  • Under the Agency Workers Regulations 2010, on completing a qualifying period with a hirer, agency workers qualify for the same basic employment conditions that they would have had if directly recruited.
  • The worker must have been in "the same role" for the whole of the qualifying period; the Regulations set out what this means.
  • The qualifying period will pause during breaks between or during assignments for certain reasons - for example, sickness absence (up to a maximum limit). In other circumstances, the agency worker will continue to accrue qualifying service when absent from the assignment.
