Work out if an agency worker has qualified for the same basic employment conditions as directly recruited workers
Key points
Under the Agency Workers Regulations 2010, on completing a qualifying period with a hirer, agency workers qualify for the same basic employment conditions that they would have had if directly recruited.
The worker must have been in "the same role" for the whole of the qualifying period; the Regulations set out what this means.
The qualifying period will pause during breaks between or during assignments for certain reasons - for example, sickness absence (up to a maximum limit). In other circumstances, the agency worker will continue to accrue qualifying service when absent from the assignment.
