Jonathan has been employed by his employer for three-and-a-half years when his contract of employment is terminated on the grounds of his long-term incapacity for work.

He has been off sick for nine months and has exhausted his entitlement to both statutory and contractual sick pay. Under his contract, he is entitled to receive one month's notice of termination of employment.
