Gemma has been employed by her employer for seven years when her contract of employment is terminated on the grounds of her long-term incapacity for work.

She has been off sick for almost a year and has exhausted her entitlement to both statutory and contractual sick pay. Under her contract, she is entitled to receive one month's notice of termination of employment.
