What is the reference period over which average weekly hours are calculated under the Road Transport (Working Time) Regulations 2005?

Several methods can be used to calculate and monitor compliance with the maximum weekly average hours under the Road Transport (Working Time) Regulations 2005 (SI 2005/639), but the chosen method must be agreed in advance. The default method sets out specific reference periods based on calendar dates. These begin at midnight on the nearest Monday morning on or after 1 April, 1 August and 1 December each year. Alternatively the employer could enter into an agreement to apply different fixed reference periods of up to 26 weeks.

Many employers will choose to agree rolling reference periods of between 17 and 26 weeks - the method used in reg.4 of the Working Time Regulations 1998 (SI 1998/1833).
