Immigration (Restrictions on Employment) Order 2004 comes into force
Implementation date: 1 May 2004
The Order provides that an employer has not
committed an offence under the Asylum and Immigration Act 1996, section 8 if
certain conditions are satisfied. These are: the employee had limited leave to
enter or remain in the United Kingdom which did not preclude his taking the
employment in question; the employee applied to the Secretary of State for
variation of that leave; or the employee is within the period during which an
appeal could be brought or has a pending appeal against refusal of that
application. The Order can be viewed on the OPSI website.
