Does an employer have to surrender confidential documents to an employment tribunal if so directed?

The employment tribunal has the same power as the county court to order disclosure and inspection of documents. However, disclosure and inspection will be ordered only when the information required is relevant or material to the case. If an employer argues that it is unable to disclose certain documents due to confidentiality, the employment tribunal has the authority to inspect the documents to assess how far, if at all, any duty of confidentiality could prevent disclosure, and can require the documents to be supplied in an edited format.
