When can an employee choose to start paternity leave in respect of a new baby?

The Paternity and Adoption Leave Regulations 2002 (SI 2002/2788) provide three options as to when an employee can choose to start paternity leave. It can begin: on the day of the birth; a specified number of days after the birth; or on a specified date that is later than the first day of the week in which the baby is expected to be born. For these purposes a week starts on Sunday. If the employee chooses to start the leave on the day of the birth and is at work on that day, the leave starts the following day.

The leave must be taken during the period of 56 days beginning with the child's birth.
