Which employees are entitled to paternity leave?

An employee is entitled to statutory paternity leave if he or she is the biological father of a child, or the spouse, civil partner or partner (of either sex) of the child's mother. An employee is also entitled to statutory paternity leave if he or she is the spouse, civil partner or partner of an individual who has adopted a child, or one of a couple who have jointly adopted a child.

The employee must have 26 weeks' continuous employment with the employer by the end of the 15th week before the expected week of childbirth (or by the end of the week of notification of being matched for adoption).
