The pensions auto-enrolment provisions apply to workers working, or ordinarily working, in the UK.
In the majority of cases, the employer will have no difficulty identifying whether or not an individual is a worker. However, where the employer is uncertain, it will need to examine the nature of the contract under which the individual is working.
