Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (Amendment) (England and Wales) Order 2016 comes into force

The Order amends the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (SI 1975/1023). It extends the circumstances in which questions may be asked about spent convictions and cautions to assess a person's suitability for admission to certain occupations or to hold certain types of employment, licences or permits. Cover is extended to:

  • activities relating to children that would constitute a "regulated activity" under the Safeguarding of Vulnerable Groups Act 2006 in relation to children, if they were carried out more frequently; and
  • the chairman, members and staff members of the Independent Police Complaints Commission who have contact with vulnerable adults or access to information about vulnerable adults or children.

The order also amends the 1975 Order to permit questions to be asked about a protected caution or protected conviction when assessing a person's suitability for a judicial appointment.
