As the transferee, comply with the obligation to inform and consult representatives in relation to a TUPE transfer
Key points
As the transferee in a TUPE transfer, an employer is obliged to provide specified information to the appropriate representatives of affected employees, including information on any measures that it envisages taking in relation to the employees.
Eligible micro-businesses may inform and consult directly with the affected employees.
The transferee's duty to inform employees applies only to its own employees who will be affected by the transfer; it does not have to provide information directly to employees who will transfer to it from the transferor.
In certain circumstances, as well as providing information to representatives of its affected employees, the transferee must consult with them prior to the transfer.
